By accessing and using xfwd.link ("the Service"), you accept and agree to be bound by the terms and provision of this agreement.

2. Description of Service

xfwd.link provides link shortening, real-time analytics, Active Protection (automated link monitoring and fallback redirection), QR code generation, and team collaboration tools. The Service is provided "as is" and "as available".

3. User Conduct

You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, impairs, renders less efficient, or restricts the functionality of the Service.

4. Account Security

You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.

5. Modification of Terms

We reserve the right to change these Terms of Service at any time without notice. Your continued use of the Service constitutes your agreement to all such terms and conditions.

6. Termination

We reserve the right to terminate your access to the Service at any time, without notice, for any reason whatsoever.

7. Disclaimer of Warranties

WE PROVIDE THE SERVICE ON A BEST-EFFORT BASIS. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLEAK DEVELOPMENT SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH (i) THE USE OR INABILITY TO USE THE SERVICE; (ii) SCHEDULED OR UNSCHEDULED MAINTENANCE; (iii) FAILURE OF THIRD-PARTY INFRASTRUCTURE PROVIDERS (INCLUDING SCALEWAY); OR (iv) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.

9. Indemnification

You agree to indemnify, defend, and hold harmless KLEAK DEVELOPMENT and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in France for the resolution of any disputes.
